Social Security Appeal Deadline Calculator

You have 60 days to appeal, and Social Security adds 5 days for mail. Enter the date on your notice to see your last day.

Pick the level you want to ask for. Each level has its own 60 days, counted from the notice for the step before it.
The date on the notice, not the day you opened the mail.

Your result…

The 60 days count from the date you receive the notice; SSA assumes you receive it 5 days after the date on the notice unless you show otherwise.

The deadline: 60 days, plus 5 for mail. Send it as early as you can.

Where each 60 days starts

  • Reconsideration: the date you receive the notice (SSA assumes 5 days after the date on the notice)
  • Hearing with an administrative law judge (ALJ): the date you receive the reconsideration notice (5 days after the date on it)
  • Appeals Council review: the date you receive the hearing decision (5 days after the date on it)
  • Federal district court: the date you receive the Appeals Council notice (5 days after the date on it)

If you miss the deadline

If you miss a deadline, ask in writing for more time and explain why. SSA looks at things like serious illness, a death in the family, lost records, wrong information from SSA, not getting the notice, or physical, mental, education, or language limits.

This tool runs in your browser. Nothing you type is sent or saved. It adds the days from the rule above. It does not change the date it shows. If the last day falls on a Saturday, Sunday or federal holiday, you get until the next business day, but don't wait.
